Permanent Jewelry Waiver and Consent Form
1. Consent to Receive Permanent Jewelry
I, the undersigned, hereby consent to the application of permanent jewelry using a welding process that involves the use of a mini-TIG (tungsten inert gas) or pulse arc welder to fuse the metal. I understand that this process involves attaching a metal piece to my body without traditional clasps, and the jewelry will be applied directly to my wrist, ankle, neck, or other specified area.
2. Acknowledgment of Risks and Limitations
I understand and acknowledge the following risks and limitations associated with receiving permanent jewelry:
• Jewelry Breakage & Snags: While permanent jewelry is designed to be long-lasting, I acknowledge that it is not indestructible. The jewelry may experience snags, breakage, or stress fractures due to physical activities, environmental factors, or accidents. I am aware that while the jewelry is intended to be worn continuously, it is not impervious to damage.
• Tarnishing & Aging: I understand that permanent jewelry is subject to natural tarnishing, discoloration, or aging over time due to exposure to air, water, sweat, and other environmental factors. The metal may change appearance, and this is a normal aspect of the jewelry’s wear.
• Allergic Reactions or Skin Irritations: There is a risk of allergic reactions or skin irritations from the materials used in the jewelry, particularly if I have sensitivities to specific metals. If I experience any irritation, pain, or discomfort, I will promptly remove the jewelry and seek medical advice.
• Welding Process Risks: I acknowledge that the welding process may create a bright spark at the weld point. I understand that looking directly at the spark without appropriate eye protection may cause retina damage or other serious eye injuries. I agree to follow all safety guidelines and will not look directly at the spark during the process. I also understand that the welding process, although generally safe, carries inherent risks, including the possibility of burns or injury from heat exposure. While such occurrences are unlikely, I acknowledge the potential for burns or other injury and agree to release all too weld, llc from any liability should such an event occur.
• Known Conditions: I acknowledge that I do not have a pacemaker, a sensitivity or allergy to any metals, or any other condition that might make this permanent jewelry experience unsafe.
3. No Guarantee of Permanency
I acknowledge that while the jewelry is intended to be worn continuously, it is not guaranteed to last permanently without risk of wear, damage, or breakage. Certain medical procedures, including MRI and surgery, would require the removal of permanent jewelry. I acknowledge that all too weld, llc is not responsible for any discomfort or removal if the body part receiving the permanent jewelry changes in size or shape over time, such as due to weight fluctuations, growth, or other factors. I understand the process and acknowledge that the jewelry may need to be repaired, replaced, or removed at some point in the future.
4. Removal of Jewelry
I understand that the jewelry can easily be removed using jewelry cutters or scissors at the jump ring or chain link. If I wish to remove the jewelry, I agree to do so using these tools or seek assistance in doing so safely. I understand that attempting to remove the jewelry by any other method could result in damage to the jewelry or injury to myself.
5. Release of Liability
I, for myself, my heirs, and my legal representatives, hereby release and hold harmless [Business Name], its employees, agents, contractors, and associates from any liability, claims, damages, or costs arising from the application, maintenance, or removal of the permanent jewelry. This release includes, but is not limited to, injury, allergic reactions, infections, skin damage, burns, or any other unforeseen consequence.
6. Acknowledgment of Understanding
I acknowledge that I have read, understood, and asked any clarifying questions to my technician regarding the information above, and I voluntarily choose to proceed with receiving permanent jewelry. I fully accept the risks and limitations associated with this process and waive any rights to claims for damages resulting from the procedure. I understand that this form is legally binding and that by signing it, I am waiving certain legal rights.
